TMIGolf Terms and Conditions of Business

(Effective January 1, 2020) 

 

Conditions & General Information: 

We want our clients to feel comfortable and confident booking with TMIGolf. Therefore, depending on travel restrictions, we will refund all funds that are returned to us if a pandemic interferes with your trip. Many golf courses will, at the minimum, postpone your teetimes to another year and many hotels will refund depending on the booking made. When booking, we pay the higher rate that is refundable, we do not book non-refundable hotel rooms. This Itinerary is an example of your trip. Confirmation with hotels, golf courses and transportation will be made after a 50% deposit is paid. All Government regulations must be followed regarding travel. Booking air travel is not recommended until after itinerary is finalized by main group contact and TMIGolf.

 

Deposit & Final Payment: 

Bookings will take place when all deposits are received. Final payments are due 10 weeks prior to travel.

Cancellation: 

Notification of cancellation by a client must be forwarded in writing to TMIGolf. Cancellation charges vary dependent on the travel package purchased. The schedule of cancellation charges for various packages is listed at the base of these conditions. No refund will be made for unused portions of a travel package.

 

Travel Insurance

We strongly recommend purchasing travel insurance for any trip when traveling overseas. You never know what might pop up at the last minute. When purchasing our golf trips, travel insurance is available for purchase.

 

Car Rental: 

On independent tours with a rental car, all drivers must be over 25 years of age, and in some destinations under 74.

 

Air Travel: TMIGolf does not include air travel, all fees, transactions or cancelations are at the responsibility of the traveler and is separate of our golf tours.

 

Documentation: For US citizens, a current passport is required for overseas travel. Please check for visa requirements in the “Special Destination Notes” section. Citizens of other countries should check with the appropriate Embassy. It is the responsibility of the traveler to know the documents and requirements of the country they are entering including any vaccination or quarantine requirements. TMIGolf begins each golf tour in the country of travel. If there are quarantine requirements, it is assumed the traveler has quarantined legally and appropriately prior to beginning the tour.

 

Golf Handicaps: 

Many golf clubs require visitors to show handicap cards. While this is not particularly common, we recommend you travel with a handicap card, and accept no responsibility if you do not and are subsequently denied golf. Certain clubs also place maximum handicap restrictions on visitors. If your handicap is greater than 24 (men) or 36 (ladies) please notify us in order we can discuss which clubs may have relevant restrictions. Also, please note that TMIGolf can accept no responsibility for the playing conditions of any golf courses, including changes caused by course maintenance or weather conditions.

 

Responsibility: 

TMIGolf, as the tour operator, and its selling agents act only as agents in securing and booking the hotel accommodations and other land tour services provided as others as independent contractors. TMIGolf, its selling agents or the specified air carriers assume and accept no liability for injury, loss, damage, accident. delay, changes or inconvenience caused by: any force majeure - health risks - reason of war or threat of war – riots - civil strife - terrorist activity - industrial disputes – acts, omission, neglect, delay or default of any person engaged in providing any tour services including transportation and accommodation - technical problems to transport - closure or congestion of airports or ports - building work - extended hotel closure - cancellations or changes of schedules by airlines - interruption or failure of public utilities outside the control of the hotel and similar events beyond our control, including storms, tempests and hurricanes.

If any tour service or its reasonable equivalent is not provided due to events beyond the reasonable control of TMIGolf, the company will make an appropriate refund of that portion of the tour price covering the undelivered tour service, but it is understood that TMIGolf shall have no other or further responsibility or liability either for the accuracy of any representation or the non-provision of any tour services.

Transport by aircraft, rail, ship or coach will depend on the conditions of carriage of the relevant carrier. These conditions of carriage may limit or exclude the carrier’s liability to you under international law (such as the Warsaw Convention). The responsibility and liability of the specified air carriers respecting their performance of air transportation services are limited by and subject to the conditions of contract in the passenger ticket, the rules contained in tariffs on file with U.S. Department of Transportation (available for inspection on request), and applicable provisions of law and treaty.

TMIGolf is not liable for loss, damage or theft of luggage or personal belongings, for personal injury, accident or illness on any vehicle or at any place throughout the tour.

TMIGolf reserves the right to cancel a tour if circumstances so require. In the event of such, TMIGolf will make a full refund to travelers of all payments received in respect of the tour. Such a refund of payments will be the full extent of TMIGolf obligation and liability to travelers. This Agreement shall be governed by the substantive laws of the Kingdom of Fife, Scotland. The parties irrevocably agree that any judicial proceedings relating to this agreement will be filed in a court of competent jurisdiction within the Kingdom of Fife, Scotland, UK.

 

Brochure Accuracy: 

As far as is known all information in the promotional and other materials of the Company is accurate at the time of publication. Changes cannot be made after publication date, and the Company accept no responsibility for any omissions or errors. Where they become aware of errors which could materially affect your travel package, they will take all reasonable steps to inform you in a timely manner.

 

Caddies: 

As a free service to clients, TMIgolf will request caddies for those who wish them, however they cannot be guaranteed. They may only be requested for the entire duration of a trip, and not for individual rounds. If you request caddies, TMIgolf will forward a request for caddies in advance of your visit. The golf clubs will make every effort to secure caddies but they are neither employed by the golf clubs nor by TMIgolf. Please consult with your Golf Travel Specialist at TMIgolf regarding the likelihood of accessing a caddie on your selected courses. In general the demand for caddies at most courses exceeds the availability. If a caddie is secured for you, the caddie master or another club official will inform you of the caddie charge and tipping policy.

 

Required Mobility & Fitness: Aspects of TMIgolf trips may require a certain level of fitness and mobility in order for a guest to participate fully. Activities may include walking over uneven or rough surfaces, stepping on/off buses, walking up/down stairways where elevators do not exist, stepping in/out of tender boats or occasionally smaller boats, this list is intended as representative but is not exhaustive. If a guest has any concerns over their fitness or mobility levels they should discuss this in advance of any trip with a TMIgolf golf travel specialist and they will provide further information with regard to the activities that you are concerned about, but in general, TMIgolf activities are not designed or intended to be overly strenuous. Ultimately, guests themselves are the only people who can fully assess their capability to manage any of the activities offered, and so once booked, TMIgolf will not offer any refund or accept liability for any guest who is subsequently unable to participate (or may be prohibited from participating by any third party operator or any other relevant authority ) in any activity, included or otherwise, due to their limited fitness or mobility levels.
